General Terms and Conditions (AGB)
Scope of application
These General Terms and Conditions govern the legal relationship between you and Schweizer Skischule Einsiedeln (hereinafter referred to as SSE) for the services offered by us in our own name.
Registration / How the contract between you and SSE is concluded
The contract between you and SSE is concluded with the acceptance of your enrolment. From this point onwards, the rights and obligations arising from the contract (including these General Terms and Conditions) become effective for you and SSE.
If the person making the booking registers further customers, they are responsible for their contractual obligations (in particular payment) in the same way as for their own obligations.
The contractual agreements and these General Terms and Conditions apply to all SSE customers.
Services and prices
Our services are based on the service description in the brochure. Special requests on your part or additional agreements require the approval of the school management.
The tuition prices can be found in the brochure. Multiple tickets (3 or 6 tickets) are valid for 365 days from the date of purchase. The prices are in CHF. Conversion into EURO will be made upon payment at a conversion rate determined by SSE, considering the current exchange rate.
SSE expressly reserves the right to change brochure details, service descriptions and prices in the brochures and on the price lists prior to your booking. Should this be the case, SSE will inform you before the contract is concluded.
Payment
Payment is made immediately after conclusion of the contract or, in the case of telephone bookings, immediately before the start of the course. In addition to cash, we also accept Maestro Card, Eurocard and TWINT
Cancellation conditions
If you wish to change your booking or cancel your lessons, you must inform us personally by telephone or e-mail. No refunds will be made for changes, rebooking or cancellations made after 4.00 pm on the day before your lesson. The date and time on which your declaration is received by the booking office is decisive for calculating the cancellation or change date.
If you must cancel your lesson, you can nominate a replacement guest. If a replacement guest enters into the contract, you and the replacement guest are jointly and severally liable for payment of the entire lesson.
Cancellation of lessons
SSE is entitled to cancel your course participation if you give justified cause for this through actions or omissions. In this case, SSE will refund you the tuition fee already paid; any further claims are excluded.
Minimum number of participants: A minimum number of participants applies to all ski class lessons offered by SSE, which can be found in the brochure. If the minimum number of participants is not reached, SSE reserves the right to combine classes, cancel courses at short notice or make you an alternative offer (also for an additional charge). If lessons must be cancelled due to the minimum number of participants not being reached and you are unable to attend another course, SSE will refund the lesson price already paid. Further claims are excluded.
Depending on the weather conditions, lessons may be cancelled for safety reasons. This does not entitle you to a refund.
Program changes
SSE may change the program or individual services for legally permissible reasons, if this does not result in a significant change to the offer.
Liability
SSE accepts no liability for accidents that occur during the use of a service or event offered by SSE. Accident and liability insurance is the responsibility of the participant.
SSE is not liable to you if the non-fulfilment or improper fulfilment of the contract is due to the following causes:
- Failure on your part
- Unforeseeable or unavoidable failures of a third party who is not involved in the provision of the contractually agreed service.
- Force majeure or an event which SSE could not foresee or avert despite due care.
If you have a complaint
If the lessons do not correspond to the contractual agreement or if you do not agree with the nature of the lessons and no agreement can be reached on site, please contact the school management directly. Complaints must be submitted to SSE in writing, stating the date, incident and persons involved.
Data protection
The data you entrust to us will of course be treated confidentially. The security of your data is important to us. That is why we have gone to great lengths to make this online shop secure.
If the opportunity for the input of personal or business data (e-mail addresses, names, addresses) is given, the input of these data takes place voluntarily by the user. If we use third parties to provide the services offered, we are authorized to disclose the customer data to the third party if this is necessary for the purposes of the contract. The customer expressly agrees that the data provided by him may be stored and processed. The shop operator shall in any case maintain the confidentiality of this data and shall not sell, rent or make it available to third parties if this is not required for contractual purposes.
Legal validity of this disclaimer
This disclaimer is to be regarded as part of the internet publication which you were referred from. If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact.
Applicable law and place of jurisdiction
The legal relationship between you and SSE is governed by Swiss law. The place of jurisdiction is Einsiedeln.
